What Is Extended Producer Responsibility (EPR) for Plastic Waste?

Extended Producer Responsibility (EPR) is a government-mandated policy under the Plastic Waste Management Rules India that makes producers, importers, and brand owners responsible for the full lifecycle of the plastic they put into the market — including collection, recycling, and safe disposal after use.

In simple terms: if your business sells or uses plastic packaging, you are legally responsible for making sure that packaging is properly collected and recycled after use. This responsibility is tracked, reported, and enforced through the CPCB EPR portal.

The EPR framework in India was introduced through the Plastic Waste Management Rules 2016, and has been strengthened through amendments in 2021, 2022, 2024, and 2026 — making it one of the most actively enforced environmental compliance frameworks in the country.

Key principle: "Polluter Pays" — whoever introduces plastic into the market must also fund and manage its end-of-life disposal.

Who Needs Plastic Waste EPR Registration?

EPR registration under PWM Rules is mandatory for the following:

1. Producers of Plastic Packaging

Any company or individual that manufactures plastic carry bags, multilayer packaging, plastic sheets, flexible packaging, rigid containers, PET bottles, plastic films, or any plastic product used for wrapping or packaging a commodity must register as a Producer under EPR.

2. Importers

Any person or business that imports goods into India — whether the goods themselves are plastic, or the goods are packed in plastic packaging — must register as an Importer under EPR. This includes:

  • Importers of plastic raw materials such as resin, pellets, granules, and preforms (mandatory since July 2025 for customs clearance)
  • Importers of products wrapped in any plastic packaging
  • IT/ITeS companies, R&D units, and service providers who import goods in plastic packaging

3. Brand Owners

Any company or person that sells goods in India under a registered brand name or trademark and uses plastic packaging for those goods must register as a Brand Owner. This includes:

  • FMCG brands
  • Food and beverage companies
  • Pharmaceutical and cosmetic brands
  • Online marketplace sellers (Amazon, Flipkart, Meesho, etc.)
  • Retail chains and supermarkets (except micro and small enterprises under MSME criteria)

4. Plastic Waste Processors (PWPs)

Recyclers, waste-to-energy operators, waste-to-oil processors, and industrial composting units that process plastic waste must also register on the CPCB portal as PWPs.

5. E-Commerce Sellers

Individual sellers on Amazon, Flipkart, Meesho, or any marketplace who sell packaged products with plastic packaging are now required to have a valid EPR certificate. Marketplaces are actively suspending accounts without valid registration.

Which Sectors and Products Require EPR Registration?

EPR for plastic waste applies across all sectors that produce, import, or use plastic packaging. Below are the key industries and product types covered:

  • FMCG & Consumer Goods — Packaged foods, beverages, snacks, personal care products, cleaning products, household goods — all categories using plastic packaging (pouches, sachets, bottles, wrappers).
  • Food & Beverage — Water bottles, soft drink containers, juice pouches, edible oil packaging, dairy packaging, frozen food packaging.
  • Pharmaceuticals & Healthcare — Medicine blister packs, plastic bottles, packaging films, medical device packaging (excluding implanted devices).
  • Electronics & Appliances — Electronic products shipped with plastic packaging, bubble wrap, foam, shrink wraps, and protective plastic covers.
  • Agriculture — Mulch films, greenhouse films, drip irrigation tubing, and other agricultural plastic films.
  • Retail & E-Commerce — Poly bags, courier packaging, air pillows, stretch wrap, and any plastic used for product delivery.
  • Automobile & Industrial — Auto parts and industrial goods packed in plastic, stretch films, shrink wraps used in warehousing.
  • Import & Distribution — Any importer who brings goods into India — regardless of the product category — if those goods are wrapped in plastic packaging.

Plastic Packaging Categories Under EPR (PWM Rules)

The PWM Rules divide plastic packaging into five categories. Your EPR obligation and recycling targets depend on which categories you use:

  • Category I — Rigid Plastic Packaging: Bottles, containers, boxes, crates, clamshells. Examples: PET bottles, HDPE containers, plastic jars.
  • Category II — Flexible Plastic Packaging (Single and Multilayer): Pouches, wrappers, sachets, films, carry bags (non-compostable), chip packets, biscuit wrappers, multilayer packaging (MLP), tetra packs, laminated pouches.
  • Category III — Plastic Used in Commodities: Plastic packaging used for commodities not covered under Category I and II.
  • Category IV — Compostable Plastic Packaging: Carry bags and packaging made of compostable plastic as per IS 17088 standards.

Registration Process — Step by Step

Step 1: Eligibility & Category Assessment

Identify whether your business is a Producer, Importer, or Brand Owner. Determine which plastic categories apply. Calculate approximate plastic quantity (in metric tons) for the last two financial years.

Step 2: Document Collection

Gather all required documents (see checklist below). Prepare your EPR Action Plan, a written plan showing how you will collect and recycle plastic waste.

Step 3: Create Account on CPCB EPR Portal

Register at the official CPCB EPR portal (eprportalcpcb.in) using company email, GST number, and PAN. Verify through OTP.

Step 4: Fill the PIBO Application Form

Select your registration category. Fill in business details, product information, plastic type and quantity data, brand names, and packaging specifications. Submit Form I (for PIBOs) along with your Action Plan.

Step 5: Upload Documents

Upload all documents clearly. File sizes should be under 5MB each. Blurry or incomplete documents are the top reason for application rejection.

Step 6: PRO and Recycler Coordination

Tie up with a CPCB-authorised Producer Responsibility Organisation (PRO) or directly with authorised Plastic Waste Processors (PWPs). Submit the MOU or agreement as part of the application.

Step 7: Pay Registration Fee

Pay the applicable government fee online through net banking or UPI. Keep a screenshot of the payment receipt.

Step 8: Application Review by CPCB / SPCB

CPCB or SPCB will review your application. If queries are raised, respond promptly. Average review time is 15 to 30 working days.

Step 9: Receive EPR Certificate

Once approved, download your PWM Authorization Certificate and EPR Registration Certificate from the portal dashboard.

Who Registers with CPCB vs SPCB?

  • Businesses operating in more than two states or Union Territories must register with CPCB (Central Pollution Control Board).
  • Businesses operating in only one or two states must register with the concerned SPCB (State Pollution Control Board) or PCC.

Documents Required for Plastic Waste EPR Registration

The following documents are needed for a complete and error-free application:

  • Company PAN Card
  • GST Certificate (current and valid)
  • Certificate of Incorporation / CIN (from MCA)
  • Import Export Code / IEC — mandatory for importers
  • Plastic type details — category, polymer type (PET, HDPE, LDPE, PP, MLP, etc.)
  • Annual plastic quantity data — last 2 to 3 financial years (in metric tons)
  • Brand list — all brands under which plastic packaging is sold
  • Product details and HSN/SAC codes
  • Authorised signatory details and ID proof (Aadhaar / Passport)
  • Registered office and manufacturing unit address proof
  • EPR Action Plan — waste collection and recycling strategy
  • PRO or recycler MOU (agreement with an authorised recycler or PWP)
  • MSME Certificate (if applicable)
  • SPCB Consent to Establish / Consent to Operate — for certain categories and states
  • Previous EPR Certificate (if applying for renewal or update)

Post-Registration Compliance Requirements

Getting the EPR certificate is only the first step. Ongoing compliance is equally important. Failure to meet post-registration requirements can lead to registration cancellation, Environmental Compensation (EC) notices, and legal action.

1. Meet Annual EPR Recycling Targets

Every year, CPCB assigns a recycling target based on the quantity of plastic you sold or imported in the previous two financial years. You must ensure this quantity is collected and recycled through authorised PWPs.

Target formula for producers and importers: Q = (Average plastic quantity sold in last two years) − (Plastic returned/recycled internally)

2. Procure EPR Credits

EPR credits are digital certificates issued by CPCB-registered Plastic Waste Processors confirming that a specific quantity of plastic waste has been processed. You must procure sufficient EPR credits to meet your annual target. Credits can be bought on the CPCB portal and can also be traded if you have a surplus.

3. File Annual Returns

You must file an Annual EPR Return on the CPCB portal every financial year, reporting:

  • Total plastic packaging sold or imported (in MT)
  • Quantity of waste collected and recycled
  • EPR credits procured
  • Details of authorised recyclers used

Deadline: Typically 30 June of the following financial year (the FY 2024–25 deadline was extended to 30 September 2025 — always check CPCB for current dates).

4. Work Only with Authorised Recyclers and PWPs

All plastic waste must be routed through Plastic Waste Processors authorised by CPCB. Using unauthorised recyclers is illegal and can result in penalties.

5. Maintain Proper Records (Form 2)

Keep detailed records of all plastic quantities, collections, transport, and recycling activities. These records must be preserved and made available during CPCB or SPCB audits.

6. Meet Recycled Content Requirements (From FY 2025–26)

Starting FY 2025–26, your plastic manufacturing or procurement must include a minimum percentage of recycled plastic content as per CPCB guidelines. This percentage increases every year.

7. Consumer Awareness

Run campaigns to educate your customers on responsible plastic disposal. This can be done through product labels, website content, social media, or in-store communication.

8. Comply with Single-Use Plastic (SUP) Ban

Since 1 July 2022, the following single-use plastic items are banned in India: plates, cups, cutlery, straws, stirrers, polystyrene items, balloon sticks, ice cream sticks, and plastic flags below a certain thickness. Businesses must stop manufacturing or importing these items immediately.

Note: Paying Environmental Compensation does not remove your EPR obligations. You are still required to meet your recycling targets.

Eligibility Criteria Summary

You are eligible and required to register for Plastic Waste EPR if:

  • You manufacture plastic packaging or products in India
  • You import goods that are plastic, or goods that come wrapped in plastic packaging
  • You import plastic raw materials (resin, pellets, granules, preforms, films)
  • You sell products under your own brand name using plastic packaging
  • You sell products on an e-commerce platform with plastic packaging
  • You are a retail chain or supermarket selling packaged goods (except micro and small enterprises)
  • You operate a plastic waste recycling, waste-to-energy, or waste-to-oil facility

You are NOT required to register if:

  • Your business is a micro or small enterprise (as per MSME criteria) that only sells at retail but does not manufacture or import plastic packaging
  • Your products are fully exempt under the PWM Rules
